Say Anything: An Argument Against Hate Crime Legislation

    A crime is a crime. They killed him. Period. Why should someone's motivation have any bearing on the actions committed?

    And what do you tell the family of a murder victim who happens to be a stright white male when the killer gets a lesser sentence than the killer of a black or gay man? That the other family deserved more justice because of the victim's race or sexual orientation?

    Hate crime legislation should be struck down at the highest level possible immediately, it is a perversion of our justice system.

    You're right, "hate" crimes make absolutely no sense. And the Yanks/Sox scenario is a good example. Say some poor yahoo wearing a BoSox cap stumbles across my line of sight, and I'm in a particularly crappy mood, so I whomp him. Asked why I did it, I reply, "screw the Red Sox." So the judge gets to tag extra time on my sentence? Why? I've already proved myself an idiot by hitting the guy; the hat was just my excuse.

    The Sheppard case always bugged me because of the gag order put on the two losers who killed him. I wanted to know how the hell they knew he was gay?

    Yeah, cause being a closted bisexual really would prevent one from being openly and violently homophobic. Get real.

    Michelle Malkin does her usual great job of linking to stuff without looking in too deeply. McKinney agreed not to talk to the press as part the plea bargain that saved his life. (A plea bargain, mind you, the victim's family helped broker with prosecutors who wanted the death penalty). And he wasn't convicted of a hate crime - that legislation passed after Shepard's death - he was convicted of murder.

    If he doesn't have new evidence showing he's not guilty, he should shut up, rot until he dies in prison, and let the Shepard family try and live their lives.
